1. Acceptance of Terms

Welcome to Kaizen Daily. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TASTECH Pte. Ltd. ("Company," "we," "our," or "us"), governing your access to and use of the Kaizen Daily mobile application ("App") and all associated services.

By downloading, installing, or using Kaizen Daily, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including free and premium users.

3. User Accounts

3.1 Eligibility

You must be at least 13 years of age to use Kaizen Daily. By creating an account, you represent and warrant that you meet this age requirement. If you are between 13 and 18 (or the age of majority in your jurisdiction), you confirm that you have your parent or guardian's permission to use the App.

3.2 Account Creation

You may use the App with or without a registered account; however, a registered account is required to access premium features and to sync data across devices. Registration requires a valid email address.

3.3 One Account Per User

Each user may maintain one active account. Creating multiple accounts to circumvent restrictions or subscription limits is not permitted.

4. Subscription Terms

4.1 Free and Premium Tiers

Kaizen Daily offers a free tier with limited functionality and a Premium subscription that unlocks the full feature set. Premium features include unlimited entry history, weekly reflections, AI-powered weekly summaries, and data export.

4.2 Pricing

Prices are displayed in USD and may vary by region due to local currency conversion, taxes, and App Store pricing tiers. The price you see in the App Store or Google Play at the time of purchase is the applicable price.

4.3 Free Trial

We may offer a free trial of Premium at our discretion. Trial terms (duration, eligibility) will be specified at the time of the offer. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

4.4 Automatic Renewal

Premium subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current price, unless you cancel at least 24 hours before the renewal date. Renewal charges will be applied to your payment method on file with Apple or Google.

4.5 How to Cancel

You may cancel your subscription at any time through:

Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until then. We do not offer prorated refunds for unused portions of a subscription period.

4.6 Refund Policy

All purchases and refund requests are handled by Apple (App Store) or Google (Google Play) according to their respective refund policies. Kaizen Daily does not process refunds directly. For refund requests, please contact Apple Support or Google Play Support.

4.7 Price Changes

We reserve the right to change subscription prices. If the price increases, we will notify you in advance through the App or email, and the change will apply to your next renewal period. Continued use after the price change constitutes acceptance of the new price.

5. Acceptable Use

5.1 Permitted Use

Kaizen Daily is provided for your personal, non-commercial use for the purpose of self-improvement and habit tracking.

6. Intellectual Property

6.1 Our Intellectual Property

All content, features, and functionality of Kaizen Daily — including but not limited to the software, design, graphics, logos, text, and the "Kaizen Daily" brand — are owned by TASTECH Pte. Ltd. and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6.2 Your Content

You retain full ownership of all content you create within the App, including your daily entries and weekly reflections ("User Content"). By using the App, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing the App's functionality to you.

We will not use your personal journal entries for marketing, training AI models (except where you opt into AI summary features as described), or any purpose beyond operating the service.

6.3 Feedback

If you submit feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without obligation or compensation to you.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Kaizen Daily, you agree to the data practices described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, we disclaim all warranties, including:

Kaizen Daily is a personal journaling and productivity tool. We make no claims that the App will improve your health, productivity, or any specific life outcome. The AI-generated summaries are informational suggestions only and should not be treated as professional medical, psychological, or clinical advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASTECH PTE. LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Our total aggregate liability to you for any claims arising from these Terms or your use of the App shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $10.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Governing Law and Dispute Resolution

These Terms and any disputes arising from your use of Kaizen Daily shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to conflict of law principles.

Any legal action or proceeding arising from or relating to these Terms shall be brought exclusively in the courts of Singapore, and you consent to the personal jurisdiction of such courts. Notwithstanding the foregoing, nothing in this section shall prevent us from seeking injunctive or other equitable relief in any jurisdiction.

If you are a consumer in a jurisdiction where mandatory consumer protection laws grant you additional rights, those laws shall apply to the extent they are more protective than what is provided under Singapore law.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

12. Termination

12.1 Termination by You

You may terminate your account at any time by deleting your account through the App or by contacting us at support@kaizendaily.app. Deleting your account cancels any active subscription for the next renewal period (you will retain access until the end of the current paid period).

12.2 Termination by Us

We reserve the right to suspend or terminate your account, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or if continued operation of your account poses a risk to us or other users.

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall survive.
